No-Fault Divorce

What is the Process of a Divorce?
The divorce process is mostly administrative and conducted online through the Court system, making it more straightforward and accessible. Here’s an overview of the key steps involved:
- It begins when one or both parties submit an application form to the Court to start the divorce.
- Both parties must complete and submit specific forms at different stages of the process.
- After the application is accepted, the Court issues a conditional order (previously called the Decree Nisi), confirming there’s no reason to stop the divorce. There is a mandatory waiting period of around six weeks and one day after the conditional order.
- Either party can then apply for the Final Order (formerly Decree Absolute), which legally ends the marriage.
Typically, the entire process takes about 7-8 months from start to finish. However, this timeframe may be extended if the Final Order is delayed pending the resolution of financial matters or child arrangements.
