There is only one ground for civil partnership dissolution in England and Wales, which is the ‘irretrievable breakdown’ of the civil partnership.
This ground must be supported by one of four set facts. These are:
- Unreasonable behaviour
- Separation for two years, and both parties consent to the divorce
- Desertion for two years
- Separation for five years.
As with divorce proceedings, dissolving a civil partnership is done by the court and is largely administrative in nature. Specific forms and documents are required to be completed by both parties during the process and submitted to the court at certain stages.
If a civil partnership dissolution isn’t contested, the process takes approximately 4-6 months all in all. There are times when it can take longer, particularly if we agree not to apply for your Decree Absolute until financial matters are resolved.
